Vinyl products

Vinyl records may contain normal characteristics associated with vinyl manufacture, pressing, packaging, and storage.

Where a product is described as a limited edition, the stated number of copies refers to the edition information provided by EXPERIMENTALBASS RECORDS.

Second-hand products

Second-hand vinyl and other used products will be described as accurately as reasonably possible, including their condition where applicable.

Any specific defects, marks, damage, writing, sleeve wear, label wear, or other relevant condition information known to us will be disclosed in the product description where reasonably possible.

Consumers purchasing second-hand goods retain the mandatory legal protections applicable under Spanish and EU consumer law. Where legally permitted, a specific shorter conformity period may be agreed for second-hand goods, but it will never be less than one year from delivery.

SECTION 4 - ORDERS

When you place an order through the website, you are making an offer to purchase the products selected.

An order is considered accepted when EXPERIMENTALBASS RECORDS confirms the order or otherwise confirms that the products have been dispatched.

We reserve the right to refuse or cancel an order where there is a legitimate reason, including:

the product being unavailable;
an obvious pricing or description error;
suspected fraudulent activity;
payment failure;
technical errors;
circumstances beyond our reasonable control; or
other circumstances permitted by applicable law.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled products using the original payment method unless otherwise agreed.

EXPERIMENTALBASS RECORDS does not normally have access to complete payment card details processed by third-party payment providers.

An order may not be dispatched until payment has been successfully authorised or received.

SECTION 7 - SHIPPING AND DELIVERY

We ship orders using the shipping methods available at checkout or otherwise agreed with the customer.

Delivery times displayed on the website are estimates unless a specific delivery date or period has been expressly agreed.

We will make reasonable efforts to dispatch orders within the indicated processing period.

Where no specific delivery period has been agreed, applicable consumer law may require delivery within the statutory period.

For consumer purchases, the seller remains responsible for the goods until they are delivered to the consumer or to a third party designated by the consumer, unless an applicable legal exception applies.

Once an order has been delivered, responsibility for the goods passes to the consumer in accordance with applicable law.

We are not responsible for delays caused by circumstances beyond our reasonable control, including customs procedures, strikes, natural disasters, carrier disruptions, or other exceptional circumstances.

If an order is lost, damaged, or significantly delayed, please contact us so that we can investigate the matter with the carrier.

SECTION 8 - INTERNATIONAL SHIPPING AND CUSTOMS

Orders shipped outside the European Union may be subject to customs duties, import taxes, handling fees, or other charges imposed by the destination country.

Unless expressly stated otherwise at checkout, such charges are the responsibility of the recipient.

Customs procedures and charges vary between countries and are outside the control of EXPERIMENTALBASS RECORDS.

Customers are responsible for providing accurate delivery information and complying with applicable import requirements in their country.

SECTION 9 - RIGHT OF WITHDRAWAL / RETURNS

Where the customer is a consumer and the purchase is subject to statutory distance-selling rules, the consumer generally has the right to withdraw from the purchase within 14 calendar days without giving a reason, subject to the legal exceptions.

The withdrawal period normally begins on the day the consumer, or a third party designated by the consumer other than the carrier, receives the goods.

To exercise the right of withdrawal, the consumer must clearly inform EXPERIMENTALBASS RECORDS of the decision to withdraw before the applicable period expires.

Unless EXPERIMENTALBASS RECORDS offers to collect the goods, the consumer must return the goods without undue delay and normally within 14 calendar days after communicating the withdrawal decision.

Unless otherwise required by law or agreed by EXPERIMENTALBASS RECORDS, the consumer is responsible for the direct cost of returning the goods.

The consumer is responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods, where permitted by applicable law.

SECTION 10 - EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The statutory right of withdrawal does not apply where an applicable legal exception exists.

For EXPERIMENTALBASS RECORDS, this may include, where legally applicable:

sealed audio, video, or software products that have been unsealed after delivery;
digital content where performance has begun with the consumer's prior express consent and acknowledgement that the right of withdrawal is lost;
personalised or custom-made products;
products that cannot be returned for reasons of health protection or hygiene once unsealed, where applicable; and
other statutory exceptions provided by applicable law.

For vinyl records, customers should therefore avoid opening or unsealing products where they intend to exercise the statutory right of withdrawal, unless the law provides otherwise.

SECTION 11 - REFUNDS

Where a consumer validly exercises the statutory right of withdrawal, EXPERIMENTALBASS RECORDS will reimburse the payments received, including the applicable standard delivery cost, subject to the conditions and exceptions established by applicable law.

If the customer selected a more expensive delivery method than the least expensive standard delivery option offered, the additional cost does not have to be reimbursed where permitted by law.

Refunds will normally be made using the same payment method used for the original transaction, unless another method has been agreed and provided that the consumer does not incur additional fees.

We may withhold reimbursement until we have received the returned goods or the consumer provides evidence that the goods have been returned, whichever occurs first, where permitted by law.

SECTION 12 - LEGAL GUARANTEE AND LACK OF CONFORMITY

EXPERIMENTALBASS RECORDS complies with the mandatory legal guarantees applicable to goods sold to consumers.

For new goods sold to consumers in Spain, the seller is responsible for lack of conformity that exists at the time of delivery and becomes apparent within three years from delivery, subject to applicable legal conditions.

For second-hand goods, a shorter period may be agreed with the consumer where permitted by law, but it may not be less than one year from delivery.

Where a product is not in conformity with the contract, the consumer may have the legal right to appropriate remedies, which may include repair, replacement, price reduction, or termination of the contract, depending on the circumstances and applicable law.

Where repair or replacement is applicable, it will be carried out without charge to the consumer where required by law, including necessary shipping, transport, labour, and material costs.

Nothing in these Terms limits or excludes mandatory statutory consumer rights.

SECTION 13 - PRODUCT DAMAGE OR INCORRECT ITEMS

If you receive a product that is damaged, incorrect, incomplete, or materially different from the product ordered, please contact us as soon as reasonably possible at:

This information helps us investigate the problem and, where appropriate, process the applicable remedy.

Occasionally there may be information on or in the Services that contains typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, offers, shipping charges, transit times, product availability, or other information.

We reserve the right to correct such errors, inaccuracies, or omissions and to update information where reasonably necessary.

If an obvious error affects an order and the applicable law permits cancellation or correction, we may contact the customer to explain the situation and provide the available options.

Nothing in this section limits mandatory consumer rights.
